Public Hearing: Approve Sewer Privilege Fees for Delayed Betterments for Public Service Uses
The Provincetown Water and Sewer Board will hold a public hearing in the multi-purpose room at the Veterans Memorial Community Center, 2 Mayflower St., Provincetown, MA 02657 on January 4th, 2024 at 2:00 p.m. for the purpose of assessing the following “public service use” properties a “sewer privilege fee” with their Betterment payments to be delayed until time of actual connection to the Town’s sewer system, as recommended by the Select Board and as provided by Article 11 of the April 2021 Annual Town Meeting.
For a Phase 4 property approved by the Select Board in 2019 for an Economic Development Permit:
At the current betterment rate of $55/GPD

Sewer Privilege Fees for Delayed Betterments for Public Service Uses.
Annual Town Meeting – May 1st, 2021 – Article 11. Sewer Assessments for Public Service Uses.
To see if the Town will vote, pursuant to Section 4 of Chapter 157 of the Acts of 2000 and General Laws Chapter 83, Section 17, to set the method of sewer assessments for all future connections to the Town’s sewer system for properties the Select Board determine to be a public service use and which receive either an economic development permit pursuant to Section 5.15 of the Town’s General Bylaws or is an inclusionary housing project approved by the Planning Board as a sewer privilege fee to be paid at the time of actual connection to the Town’s sewer system; and further to amend the vote taken under Article 10 of the April 2015 Special Town Meeting by adding the following at the end of the main motion: “; provided, however, that for properties in Phase IV that have been determined by the Select Board to constitute a public service use and have received either an economic development permit pursuant to Section 5.15 of the Town’s General Bylaw or is an inclusionary housing project approved by the Planning Board, shall be assessed a sewer privilege fee to be paid at the time of actual connection to the Town’s sewer system; or to take any other action relative thereto.
Explanation of Article 11: This article allows the Town to change its method of betterment assessment for public service projects (like Economic Development Permits and Affordable Housing Projects) to allow the betterment to be assessed upon hook-up of the project to the sewer. This removes a burden on new construction projects that are forced to pay betterment costs upfront before the project is even able to obtain all its approvals and start construction. This article recognizes that these important projects meet critical Town needs and should be supported by our Town process and procedures.
Public Hearing: Proposed Sewer Betterment Rate Increase and Assessments for Future Connections
The Provincetown Water and Sewer Board will hold a public hearing in the multi-purpose room at the Veterans Memorial Community Center, 2 Mayflower St., Provincetown, MA 02657 on January 4th, 2024 at 2:00 p.m. to discuss the proposed sewer Betterment rate increase and other assessment provisions for future connections approved by the Voters at the Nov. 2022 Special Town Meeting.
Article 5 approved by the Voters at the Nov. 2022 Special Town Meeting “authorizes the Water and Sewer Board to assess one hundred percent of the Phase 6 Sewer Expansion project cost to the Town upon those who benefit from the project, such assessments to be made by the Uniform Unit method; and further to authorize the Water and Sewer Board to set the method of sewer assessments for future connections to the Town’s sewer system as a sewer privilege fee pursuant to G.L. c. 83, §17, to be paid at the time of actual connection to the Town’s sewer system for properties that have a Title 5 compliant septic system installed after January 1, 2000 according to the records of the Health Department, with all other properties that abut a sewer main to be assessed a betterment pursuant to G.L. c. 83, §15; provided further that the Water and Sewer Board shall equitably adjust the amount of assessments made pursuant to this vote to take into account the need for the homeowner to pay for and install a grinder pump for connection to low pressure lines.”
To implement the provisions of Article 5 as approved by the voters, the following are proposed:
Proposal #1 would increase the existing betterment rate of $55.00 per Title 5 gallon to $65.00 per Title 5 gallon based upon the estimated cost to implement the Phase 6 Sewer Expansion Project after taking into account all anticipated grants and subsidies. As provided by Chapter 83, the $65.00 rate will be the “estimated sewer assessment” that will apply to Phase 6 with the “actual sewer assessment” rate to be determined after construction has been completed and sewer service is available for the property.
Proposal #2 would equitably adjust the “estimated sewer assessment” to $45.00 per Title 5 gallon for those homeowners who will need to pay for and install a grinder pump for connection to low pressure lines.
Proposal #3 would set the method of sewer assessments for future connections to the Town’s sewer system as a sewer privilege fee to be paid at the time of actual connection to the Town’s sewer for properties that have a Title 5 compliant septic system installed after January 1, 2000.
Proposal #4 would set the method of sewer assessments for future connection to the Town’s sewer system for all other properties that abut a sewer main to be assessed a betterment pursuant to General Laws Chapter 83, Section15.
Proposals #1 thru #3 will take effect as soon as they have received the proper Town approvals. The provisions of Proposal #4 will not go into effect until the Legislature has Repealed the Town’s Special Act Chapter 157 of the Acts of 2000, at which time the provisions of Chapter 83 will then take effect.
