Court to Issue Limited Injunction
A state Land Court judge plans to issue a limited injunction on landowner Great White Realty and tenant GFM Enterprises regarding use of the contractor’s yard on Route 6 at Old Wharf Road in South Wellfleet. The judge has asked the town to develop a list of specific equipment and activities to be prohibited on the parcel and to submit the proposal by Dec. 2. No injunction will be issued before that date.
Great White Realty purchased the lot at 1065 Route 6 in January 2021, immediately beginning construction work without securing permits. This prompted a cease-and-desist order from the building inspector, which Great White appealed in May 2021 and followed with two more appeals of other enforcement actions.
Nearby residents complained of the noise and dust created by the operation. “I was unable to open my windows because of the dust and noise,” abutter Sanatkumar Tankalwala told the Independent in September.
Attorney Carolyn Murray of KP Law, who represents the town’s zoning board of appeals, filed the injunction request last month, citing neighbors’ complaints. Great White’s attorney Ben Zehnder argued that Great White and GFM would suffer more harm from the injunction than the zoning board would suffer if no injunction were issued.
Following the judge’s decision at the Nov. 3 hearing, neighbors will have to sit tight until Dec. 2, when the limited injunction will take effect.
WES Has Its Playground
The new Wellfleet Elementary School playground is finished, and students were able to enjoy it for the first time on Nov. 2.
The project was funded with $315,000 in Community Preservation Act funds allocated in December 2021 and additional contributions from families, friends, and other community members.
